City of Kimball Snow Removal

The City of Kimball would like to remind all snow removal operators and property owners that, per Minn. Stat. §160.2715, it is unlawful to deposit snow on or next to trunk highways, county state-aid highways, municipal state-aid streets, county highways, and town roads. Snow removal operators and property owners are prohibited from plowing, blowing, shoveling, or otherwise placing of snow onto said roadways. This includes the ditch and right-of-way area along the roadside. Furthermore, per City Ordinance 505 – Traffic and Parking Regulations, no person shall remove snow from private property and deposit the same on any public street or parking lot. Any snow so deposited may be removed by the City, and the cost of the removal shall be assessed and charged to the person in violation of this section.

Please refrain from placing snow within the road right of way (the area directly behind the curb). Please place snow in your yard so that the snow on the street is deposited within the road right-of-way and it the roads remain open to the curb.

This would also include pushing the snow from your driveway across the street onto the right-of-way of a vacant lot. The snow from your property needs to remain on your property.

According to state law, violations are considered misdemeanors, but civil penalties also apply if the placement of snow creates a hazard such as a slippery area, frozen rut, or bump that contributes to a motor vehicle or pedestrian crash. The civil liability can extend to both the property owner and the person who placed the snow.

Other hazards created by improper placement of snow on or near a public roadway include drainage problems, drifting, sight obstruction, and safe accessibility. Special attention should be made to keep crosswalks, intersections, entrances, and exits clean and unobstructed.

Also remember, per City Ordinance 400 – Nuisances, all sidewalks must be cleared of snow and ice within 48 hours after the precipitation has ceased to fall. If your sidewalk is not cleared within 48 hours, the City is authorized to start the emergency abatement process.
