Resolution calling a hearing on a petition to establish a subordinate service district
WHEREAS, the Board of Supervisors (“Town Board”) of Fair Haven Township, Stearns County, Minnesota, (“Town”) received a petition requesting the establishment of a subordinate service district pursuant to Minnesota Statutes, Chapter 365A, (“petition”) for the area shown on the map attached hereto as Exhibit A (“Proposed District Area”);
WHEREAS, the Petition requests that the Town Board improve Cattail Court and Reed Court (collectively, the “Roads”); and perform such major repairs and maintenance activities on the Roads in the future as the Town Board determines are necessary. The repairs may include, but are not limited to, seal coating, mill and overlays, repairs necessitated by frost boils, and any major repairs that exceed the annual maintenance budget developed for the Roads. The annual maintenance budget shall be an amount equal to the average amount the Town spends to maintain a gravel road of an equivalent length, as determined annually by the Town Board.
WHEREAS, the Town Clerk verified the signatures on the Petition and presented it to the Town Board at its April 1, 2024, meeting;
WHEREAS, the Town Board hereby finds the Petition is complete, was signed by the required at least 50 percent of the property owners in the Proposed District Area, and is therefore sufficient under Minnesota Statutes, section 365A.04, subdivision 1; and
WHEREAS, Minnesota Statutes, section 365A.04, subdivision 2 requires the Town Board to call and hold a hearing on a petition within 30 days from the date the verified Petition was presented to the Town Board by the Clerk.
NOW, THEREFORE, BE IT RESOLVED, by the Town Board as follows:
1. A public hearing on the Petition is hereby called and will be held on Monday, April 29, 2024, at the Fair Haven Town Hall, 5205 County Rd. 44, South Haven, MN 55382, at 7 p.m. to consider the Petition, review any written materials submitted to the Town, hear from those who wish to speak to this matter, and to act on whether to establish the proposed district.
2. The Town Clerk is hereby authorized and directed to publish notice of the hearing in the Town’s official newspaper once at least 14 days prior to the hearing, and to mail notice of the hearing to the property owners within the Proposed District Area at the addresses used by the County Auditor for mailing property tax statements. The notice mailed to the property owners shall include a copy of this Resolution, including the attached map, and a copy of the Petition.
3. Pursuant to Minnesota Statutes, section 365A.04, the Town Board shall act by resolution, either at the hearing or within 30 days thereof, on whether to approve or disapprove the establishment of the proposed subordinate service district. Futhermore, pursuant to the same section, the Town Board has the authority to modify the boundaries of the Proposed District Area and to make other changes as authorized by law as part of a resolution approving the establishment of the district.
