Resolution Adopting an Ordinance Regulating FIREARMS AND OTHER WEAPONS
The Kimball City Council ordains:
FIREARMS AND OTHER WEAPONS
Section 530.01.DEFINITIONS.
Subd. 1. Bow and Arrow. Any device or combinations of devices designed to propel any arrow from a cord connecting two (2) ends of a bow by pulling on the cord to bend the bow and then releasing the cord, excluding devices of this type commonly interpreted to be toys.
Subd. 2. Firearms. Any device from which is propelled any missile, projectile, bullet, or other mass through a barrel by an expolosive, gas, air, and/or spring device.
Subd.3. Air Rifle. A firearm that propels a projectile or other mass through a barrel by gas or air. The definition of air rifle shall include a BB-gun and a paintball gun.
Section 530.02. PROHIBITED CONDUCT.
Subd. 1. Except as specifically authorized herein, the discharging and use of a bow and arrow, firearms, or air rifle within the city of Kimball is prohibited.
Subd. 2. The aiming of any bow and arrow or firearm, whether loaded or not, at or toward any human being is prohibited.
Section 530.03. HUNTING PROHIBITED. All forms of hunting, including but not limited to hunting with firearms and bow hunting, are prohibited within the city of Kimball.
Section 530.04 EXCEPTIONS. Nothing in this Section shall be construed to prohibit the use or firing of a firearm or other weapon when such use is done by: (1) law enforcement or military personnel acting within the scope and performance of their official duties; (2) any person lawfully defending persons or property; (3) a person discharging a firearm, bow and arrow, or air rifle at an approved indoor shooting range that is built to current building code standards; (4) a person using a firearm to discharge blank ammunition in conjunction with a sporting event or ceremonial occasion; and, (5) a person using a bow and arrow on private properety or on school or city property in connection with an organized school or recreation class, if the arrows are equipped with blunt tips, which are also known as “field points” or “target arrows.”
Section 530.05. CONFLICT WITH STATE LAW. The City adopts Minnesota Statutes Section 609.66, Subdivision 1 by reference. In the event a Court of competent jurisdiction determines that any portion of this ordinance is unenforceable because it conflicts with Federal or State Statutes or Constitutions, that determination shall not affect the enforceability of the remainder of this Ordinance.
Section 530.06. PENALTY. Any person violating this Ordinance shall be guilty of a misdemeanor.
This ordinance becomes effective after its passage and publication.
