Councilmember Eric Loewen, introduced the following resolution and moved for its adoption, to amend Section 1195 as follows:

Amend 1195.02-Conditional Use Permits Required add with the exception of Storable Pools. See Section 1195.08

Amend 1195.06-Safety Fence Required change (1) from at least 5 feet to at least 4 feet; (2) add to the existing wordage Minimum requirement is chain link fencing and may be slatted.

Add Section 1195.08 Storable Pools

(1) Definition – A pool capable of holding water to a maximum depth of forty eight inches (48) or a pool with non-metallic, molded polymeric or fabric walls supported on a rigid framework or by an inflatable ring and constructed entirely on or above ground, and is designed and constructed to be readily disassembled for storage and re-assembled to its original integrity.

(2) Pool Operation – Storable pools will be allowed for use from May 1, through October 1 each year. Storable Pools shall be disassembled and stored inside for the period from October 1, through May 1. Their filtration systems must be operating and water quality must be properly maintained at all times during the periods in which they are assembled. If water quality or filtration can not be properly maintained during these periods, the pool must be disassembled and properly stored.

(3) A land use permit, which can be issued at City Hall, must be obtained yearly, shall be required for storable swimming pools capable of holding a water depth of more than 24 inches (24″) at any point and in which the pool walls are entirely above the adjacent grade and the capacity does not exceed five thousand (5,000) gallons, (according to the Building Code). All pools for which a land use permit is required, shall submit a site plan showing the size of the pool, the proposed location of the pool and its relationship to the principal building on the lot, property boundaries, fencing and other structures, including utility location and trees, the location, size, and types of equipment to be used in connection with the pool, including but not limited to, filter unit, pump, heaters or other related equipment. All pools and related equipment are required to be installed following the requirements of this code, the adopted building code and the manufacture’s printed installation instructions. Storable pools must meet all side and back yard set backs according to the Ordinance and no pool is allowed to be erected in the front yard.

(4) A General Permit is required for the Safety Fence, according to Section 1195.06 – prior to filling the pool, the approved fence or other enclosure must be installed, inspected and approved by the City Buyilding Official.

To amend Chapter 2, Administration, Section 215, add Land Use Permit fee of $10.00.

Councilmember Chris Jansky seconded the forgoing resolution. Those voting in favor of: Chris Jansky; DuWayne Orbeck; Tammy Konz; Eric Loewen, absent-Joe Krippner, motion carried and will become effective June 18, 2009.
