Pursuant to Minnesota Statutes, Section 412.851, notice is hereby given that the City Council of the City of Kimball, Stearns County, Minnesota, will hold a public hearing on Monday, June 2, 2003, at 7:15 p.m. in the City Hall to consider vacating the portion of public street legally described as follows: That part of Publisher’s Drive, GREELY EDITION, lying southerly and easterly of the following described line: Beginning at most southerly corner of Lot 5, Block 3, GREELY EDITION, thence South 31 degrees 28 minutes 07 seconds West for 66.00 feet to the southwesterly right-of-way line of Publisher’s Drive, GREELY EDITION and there terminating. Together with the 10.00 foot-wide drainage and utility easement lying easterly of, westerly of, and contiguous with the above-described portion of Publisher’s Drive. A copy of the Proposed Resolution is as follows: RESOLUTION VACATING STREET Whereas, the portion of public street legally described as follows: That part of Publisher’s Drive, GREELY EDITION, lying southerly and easterly of the following described line: Beginning at most southerly corner of Lot 5, Block 3, GREELY EDITION, thence South 31 degrees 28 minutes 07 seconds West for 66.00 feet to the southwesterly right-of-way line of Publisher’s Drive, GREELY EDITION and there terminating. Together with the 10.00 foot-wide drainage and utility easement lying easterly of, westerly of, and contiguous with the above-described portion of Publisher’s Drive is to be considered for vacation; Whereas, the Petition is signed by a majority of the owners of land abutting the part of the street to be vacated; Whereas, pursuant to ten days mailed notice to each property owner affected by the proposed vacation, and pursuant to two weeks published and posted notice, a public hearing was held on ______________, 20__ at ____ p.m. at a regular meeting of the City Council of the City of Kimball at the City Hall to consider the vacation; Whereas, it appears in the interest of the public to vacate the portion of the street as proposed; Now, therefore, be it resolved by the City Council of the City of Kimball, Minnesota that: 1. The portion of the public street legally described as follows: That part of Publisher’s Drive, GREELY EDITION, lying southerly and easterly of the following described line: Beginning at most southerly corner of Lot 5, Block 3, GREELY EDITION, thence South 31 degrees 28 minutes 07 seconds West for 66.00 feet to the southwesterly right-of-way line of Publisher’s Drive, GREELY EDITION and there terminating.
