NOTICE OF MORTGAGE FORECLOSURE SALE POSTPONEMENT

WHEREAS default has been made in the terms and conditions of a certain Mortgage, duly executed and delivered by Steven J. Swenson and Karen M. Swenson, husband and wife as joint tenants, Mortgagors, to Flagship Bank, f/k/a Community Bank Minnesota Valley, a Minnesota banking corporation, Mortgagee, the original principal amount secured by said mortgage being $75,000.00, dated the 25th day of February, 2004, and with a power of sale therein contained, recorded in the office of the County Recorder of Stearns County, Minnesota, on the day of 29th day of May, 2009, as Document No. 1288273, which said mortgage conveyed and mortgaged the following described property, situated in the County of Stearns and State of Minnesota, to-wit:

Part of Lot 9 of Auditor’s Subdivision No. 1 of the City of Eden Valley, described as follows:

Beginning at the southwest corner of said Lot 9; thence running east 63 feet; thence north 33 feet, which said last named point is the point of beginning; thence running north 85 feet; thence running East 25 feet; thence running south 85 feet; thence running west 25 feet to said point of beginning, Stearns County, Minnesota

WHEREAS, there has been compliance with any condition precedent to foreclosure of the mortgage and acceleration of the debt secured thereby required by the mortgage, the note secured thereby or any statute; and

WHEREAS, the said mortgagee has elected, in accordance with the terms of said mortgage, to declare, and has declared the whole sum secured thereby to be immediately due and payable; and

WHEREAS, there is claimed to be due upon said mortgage, and is due hereon at the date of this Notice, the sum of $137,825.77, principal and interest and no action or proceeding being now pending at law, or otherwise, to recover the debt secured by said mortgage, or any part thereof.

NOW, THEREFORE, notice is hereby given that by virtue of the power of sale contained in said mortgage, and pursuant to the statute in such case made and provided, the said mortgage will be foreclosed by the sale of said mortgaged premises with the hereditaments and appurtenances, which said sale will be made by the Sheriff of Stearns County, Minnesota, at the Stearns County Sheriff’s Office, 807 Courthouse Square, Room S100, in the City of St. Cloud, County of Stearns on Tuesday, September 15, 2009, at 10 o’clock a.m.,said sale having been postponed from the previously scheduled sale date of Tuesday, August 5, 2009, to be sold at public auction to the highest bidder, to pay the amount then due on said mortgage, together with the costs of foreclosure, including attorneys’ fees as allowed by law, in accordance with the provisions of said mortgage. The time allowed by law for redemption by the mortgagor, their personal representatives, successors or assigns, is six (6) months from the date of said sale.
