Notice is hereby given that the Stearns County Board of Adjustment, in and for the County of -Stearns, will conduct a public hearing to consider variance applications on Thursday, September 23, 2021, in Room 1104, Stearns County Service Center, 3301 County Road 138, Waite Park, Minn., beginning at 6:30 p.m.

Public Hearings:

To consider a request from Jeff, Wade & Scott Nyren et al., South Haven, Minn., from Sections 10.2.11A.(2) & 10.2.11B.(2) of -Stearns County Land Use and Zoning Ordinance #439 to reconstruct a residential dwelling with attached garage ahead of the established building line partly in the shore impact zone of a lake classified recreational development. Also, to leave as constructed two water-oriented accessory structures. Said Ordinance requires a new residential dwelling with attached garage to be constructed landward of the established building line and no closer than 50 feet from the Ordinary High Water Level of a lake classified recreational development. Also, each lot may have only one water-
orientated accessory structure not meeting the normal structure setback requirements. Affected property: 48.12A P/O NW4NW4 & Govt Lots 1 & 2, Section 1, T121N, R28W, Fairhaven Township. Property address: 1862 Bayberry Road, South Haven, Minn.

To consider a request from Lee & Barbara Haugen, St. Paul Park, Minn., from Sections 5.1.2C.(2), 5.1.2C.(3), 10.2.11A.(2) & 10.2.11B.(2) of Stearns County Land Use and Zoning Ordinance #439 to construct a deck addition ahead of the established building line and a dwelling/porch addition onto a legal nonconforming residential dwelling in the shore impact zone of a lake classified Natural Environment. Also, to leave as constructed a water-oriented
accessory structure less than 25 feet from the Ordinary High Water Level. Said Ordinance requires additions on a legal nonconforming residential dwelling to be located landward of the established building line and outside the shore impact zone of 100 feet on a lake classified Natural Environment. Also requires a water-oriented accessory structure to be 25 feet from the OHWL of a lake classified Natural Environment. Affected property: Lot 26, Block 2, Clearwater Harbor, Section 32, T122N, R27W, Lynden Township. Property address: 223 Alder Road, South Haven, Minn.

To consider a request from Anne Ackerman & Kristina Miller, Clearwater, Minn., from Sections 5.1.2C.(2), 5.1.2C.(3), 9.9.9A.(1) & 10.2.11A.(2) of Stearns County Land Use and Zoning Ordinance #439 to construct an addition on a legal nonconforming residential dwelling that is ahead of the established building line, within the shore impact zone of a lake classified Natural Environment and less than 10 feet from a side property line. Also, to leave as constructed a deck that is located ahead of the established building line, within the shore impact zone of a lake classified Natural Environment and less than 10 feet from a side property line and to leave as constructed two (2) water-oriented accessory structures. Said Ordinance requires an addition and a deck on a legal nonconforming residential dwelling to be located landward of the established building line, outside of the shore impact zone and at least 10 feet from a side property line. Also only allows for one (1) water-oriented accessory structure not meeting the normal structure setback requirements. Affected property: Lot 24, Block 1, Shores Point, Section 8, T122N, R27W, Lynden Township. Property address: 18418 Eaglewood Road, -Clearwater, Minn.
