Stearns County Board of Adjustment

Notice is hereby given that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct the following public hearings to consider variance applications:

1. After the Fact requests from Derrick Langvba of Uneek Design, Build and Remodel, Big Lake, Minn., on behalf of Christopher and Shaun Swanson, Albertville, Minn., from Sections 5.1.2 A. (1), 5.1.2 C. (2), 9.9.9 A. (3) and (4), 10.2.11 A. (1) (a) and 10.2.11 A. (2) of Stearns County Land Use and Zoning Ordinance #439 to leave as constructed, deck additions on a legal non-conforming principal structure, one being ahead of the established building line and less than 75 feet to the Ordinary High Water Level (OHWL) of Lake Louisa, classified General Development. Also, to leave as constructed, a Water Oriented Accessory Structure less than 10 feet to the side property line in an R-1 zoning district and partially within the flood fringe or 100-year flood hazard area. Last, to replace and expand a legal non—conforming residential accessory structure less than 10 feet to the side property line in an R-1 zoning district and less than 30 feet from the road right of way of Ashview Road, classified as a township road. Said Ordinance does not allow expansion of non-conforming structures or additions or alterations to a non-conforming principal structure ahead of an established building line, requires accessory structures be located a minimum
10 feet from a side property line and 30 feet from a road right of way of a township road located in an R-1 zoning district and requires structures be placed a minimum 75 feet landward of the OHWL of a lake classified General Development or behind an established building line. Affected property: That part of the West 118.5 feet of the North ½ of the NE ¼ of Section 7, lying North of Lake Marie, also known as Lake Louisa, and that part of the West 118.5 feet of the SW ¼ of the SE ¼ of Section 6, T121N, R28W, lying South of County Aid Road #7, Fair Haven Township. Property address: 12862 Ashview Rd., South Haven, Minn.

2. To consider After the Fact requests from Clearwater -Forest, Edina, Minn., from Sections 10.2.11 A. (1) (a), 10.2.11 A. (2) (b) and 10.2.11 B. (1) (a) of -Stearns County Land Use and Zoning Ordinance #439 to leave as constructed, an illegal non-conforming -principal structure (house) less than 100 feet landward of the Ordinary High Water Level (OHWL), ahead of the established building line and less than 50 feet landward of Clearwater Lake, classified Recreational Development and the lowest floor (crawl space) not meeting the minimum required Regulatory Flood Protection Elevation (RFPE). Also, from Sections 5.1.2 A. (1) and 5.1.2 C. (3) to expand the non-conforming structure located partly in the shore impact zone by constructing new deck additions. Said Ordinance requires structures to be located a minimum 100 feet landward of the OHWL of a lake classified Recreational Development or behind an established building line and a minimum 50 feet landward of the OWHL and the lowest floor must be at or above the RFPE. Also, said Ordinance does not allow for expansion of a non-conforming structure and does not allow any addition or alteration to a non-conforming structure located partly within the shore impact zone. Affected property: Parts of Government Lots 3 and 4, Section 1, T121N, R28W, Fair Haven Township. Property address: 13326 Bayview Rd., South Haven, Minn.
