Board of Adjustment

Notice is hereby given, pursuant to Minnesota Statute, Section 394.26, that the Stearns County Board of Adjustment, in and for the County of Stearns, will conduct a public hearing on Thursday, August 25, 2016, in Conference Room 121, Stearns County Service Center West, 3301 County Road 138, Waite Park, MN, beginning at 6:30 p.m.

Purpose of the hearing is to consider the granting or denial of variances from the Stearns County Land Use & Zoning Ordinance, Stearns County Subdivision Ordinance, Stearns County Sewage Treatment Ordinance, Stearns County Recreational Campground Ordinance, Stearns County Lodging Establishments Ordinance, Stearns County Childrens Camps Ordinance and the Stearns County Manufactured Home Parks Ordinance as follows:

Public Hearings:

To consider a request from Elizabeth Nystrom and Bruce Mancini, Kimball, MN from Section 10.2.11A(2)(a) of the Stearns County Land Use & Zoning Ordinance #439 to leave as constructed a 2,064 square foot residential dwelling with tuckunder garage and two decks measuring 10 feet x 28 feet (280 sq ft) and 6 feet x 20 feet (120 sq ft) 69 feet from the OHWL of an Unnamed Lake, classified as a Natural Environment Lake, in the Shore Impact Zone. The applicants are also proposing to replace and enlarge the existing 6 foot x 20 foot deck making it 8 feet by 20 feet (160 sq ft). Said Ordinance does not allow for structures to be located in the Shore Impact Zone, which is defined as 100 feet from the OHWL from lakes classified as Natural Environment. Affected Property: 25 A NW4NW4 Less N 495?Äô, Section 35, T122N, R29W, Maine Prairie Township. Property Address: 14830 93rd Avenue, Kimball, MN.

To consider a request from Loren Lynch, Kimball, MN from Sections 5.1, 7.16.2 & 9.9.9A(4) of the Stearns County Land Use & Zoning Ordinance #439 to relocate a property line on adjacent nonconforming tracts.  Said relocation will result in the creation of a new nonconforming accessory structure to be located 6 feet from the relocated property line.  Said Ordinance does not allow nonconforming lots to be reduced below the minimum requirements established in the Ordinance and accessory structures are required to be setback 10 feet from property lines. Affected Properties: Lot 8 of Hentges Lake Shore Lots & Lot 1 of First Addition to Hentges Lake Shore Lots, Section 24, T122N, R29W, Maine Prairie Township.  Property Address:  7880 Carnelian Road, Kimball, MN and Lot 2 of First Addition to Hentges Lake Shore Lots, Section 24, T122N, R29W, Maine Prairie Township. Property Address: 16661 Carnelian Road, Kimball, MN.

All applications and related information are on file with the Environmental Services Department, Room 343, County Administration Center, 705 Courthouse Square, St. Cloud, MN, and can also be viewed approximately one week prior to the meeting at co.stearns.mn.us, by clicking on Board and Committee Meetings. Action taken on these applications will be available shortly after the meeting at the same website location.

All interested persons are invited to attend said hearing or submit written testimony prior to the hearing date, either in support of or in opposition to the requests. Written testimony should be sent to the Stearns County Board of Adjustment, Stearns County Environmental Services Department, Administration Center Room 343, 705 Courthouse Square, St. Cloud, MN 56303.
