RESOLUTION EXTENDING THE MORATORIUM ON CONSTRUCTION OR INSTALLATION OF OUTDOOR FURNACES

WHEREAS, it has come to the attention of the Kimball City Council that its residents wish to construct and install outdoor furnaces for the purpose of heating their homes; and

WHEREAS, the City does not currently regulate the construction, installation or location of outdoor furnaces in any manner; and

WHEREAS, the City believes that it would be in the best interests of its citizens to regulate the location, construction and installation of such outdoor furnaces; and

WHEREAS, the Kimball City Council believes that the construction and installation of outdoor furnaces within the City prior to the City Council’s review and consideration of the regulation of such outdoor furnaces would not be in the best interests of the City and potentially create hazards for its residents; and

WHEREAS, the City Council believes that no construction of such outdoor furnaces should occur during the pendency of the Council’s review; and

WHEREAS, on September 20, 2011, the Kimball City Council imposed a six (6) month moratorium on the construction or installation of outdoor furnaces; and

WHEREAS, the Kimball City Council wishes to extend the aforementioned moratorium for an additional six (6) months; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Kimball, Minnesota as follows:

1. A moratorium is hereby imposed upon any construction, or installation of outdoor furnaces within the corporate city limits of Kimball, Minnesota.

2. This moratorium will be imposed for an additional period of six (6) months beginning from the date of the adoption of this Resolution or until such time as the review and consideration has taken place, and ordinances and regulations have been adopted by the Kimball City Council, or is otherwise determined by the City Council.

3. No permits will be issued for any construction, installation, location or operation of outdoor furnaces during the time that this moratorium is in effect. This moratorium will apply to all outdoor furnaces located within the City that have not been completed and are fully operational at the time of the adoption of this Resolution.
